so, i moved the script to /usr/local/bin end error was gone.
it is worth to note that test were run anyway and rrds filled so it was 
only a problem of web cgi checks.

i had also a problem with the graphs not being displayed but it was a 
case of order of declarations .. it seems that for a graph to be 
displayed first declarations should be menu and title then anything else 
(probe, probe options, host)
